2. The petitioner seeks bail in a case registered for the offences punishable under Sections 318(4)/319(2), 317(2), 317(4)/336(3)/112(2)/61(2) of B.N.S., 2023 as well as under Sections 66(C)/66(D) of the I.T. Act.

3. The case of the prosecution, in short, is that on secret information, the rented house of one Sonu Kumar was raided. It is alleged that from the said house, certain articles, such as, mobile phones, laptop, ATM Cards, routers etc. were recovered. The allegation against the petitioner is that he started fleeing away after seeing the police. The petitioner was on Scooty and he was apprehended.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.71566 of 2025(2) dt.14-10-2025 2/2 that nothing has been recovered from the possession of the petitioner. It is further submitted that one Banti Kumar has been granted bail by this Court vide Criminal Miscellaneous No.70823 of 2025, whose name has surfaced on the basis of confessional statement of one Shanni Kumar. It has been submitted that nothing has been recovered from Banti Kumar and same is the case with this petitioner, as such, it has been submitted that the case of this petitioner is on similar footing. The petitioner is in custody since 24.07.2025.

5. Learned APP for the State vehemently opposed the bail application by submitting that the petitioner was apprehended at the spot.

6. Considering the above facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Siwan in connection with Siwan Cyber P.S. Case No.74 of 2025.
