JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-05-2018 The petitioner, who is an Ex-Mukhiya of Srinagar Panchayat seeks bail in connection with Belhar P.S. Case No. 172 of 2017 dated 12.08.2017 instituted for the offences under Sections 406, 409, 420 of the Indian Penal Code. The petitioner is alleged to have misappropriated Rs. 28,500/- which was given to him for installing solar lights in the Panchayat and another amount of Rs. 98,000/- for furnishing the G.P. Bhawan of the Panchayat.

The learned counsel for the petitioner has submitted that the amount which was taken by the petitioner for installing solar lights has already been returned in the Government Treasury and the furniture which was purchased by him has also been handed over to the Panchayat

Patna High Court Cr.Misc. No.25945 of 2018 (2) dt.18-05-2018 2/2 Secretary. Without verifying the facts, it has been argued, the petitioner has been made accused in this case. The petitioner is in custody since 05.04.2018. For the aforestated facts, the petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, III, Banka in connection with Belhar P.S. Case No. 172 of 2017.
