JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 27.02.2017 passed in Cr. Misc. No. 8947 of 2017 with an observation to conclude the trial within a period of one year and the petitioner was given liberty to renew his prayer for bail if trial is not concluded within the said period. Submission of learned counsel for the petitioner is that there is allegation of firing on the deceased rather it is shot by one Mahesh Sharma, causing his death and petitioner is in custody since 24.08.2016.

Heard learned A.P.P also and on perusal of the report it appears that charge has been framed in this case and no witness has been examined.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.27105 of 2018 (3) dt.21-06-2018 2/2 circumstances, as stated above, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-V, Gaya, in connection with Sessions Trial No. 31 of 2017, arising out of Konch P.S. Case No. 35 of 2016, on the condition that one of the bailors shall be a local person having sufficient immovable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in disposal of the trial and appear in court as and when required, otherwise his bail bond shall be cancelled.
