JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 22-05-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code, Sections 25(1-B) a, 26, 35 of the Arms Act and Sections 8, 20(b) (ii)(c) of the N.D.P.S. Act.
There are recoveries of 2 kgs, 110 grams of charas, two motorcycles and a country made pistol and cartridges from the apprehended accused persons
Patna High Court CR. MISC. No.72453 of 2022(3) dt.22-05-2023 2/3 namely Manish Patel and Neeraj Kumar. They disclosed the name of the petitioner as a person who fled away from the place of seizure.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner and only on the basis of confessional statement of apprehended accused, the petitioner has been roped in the present case. The petitioner is languishing in custody since 15.02.2022.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, East Champaran, Motihari in connection with NDPS Case No. 95 of 2021, arising out
