2. Aggrieved by non-payment of the house rent allowance and city transport allowance, etc, the petitioner has preferred the instant writ application for the following reliefs: "That petitioner prays for issuance of a writ in the nature of mandamus

Patna High Court CWJC No.17975 of 2025(2) dt.03-12-2025 2/3 directing and commanding the respondent authorities to pay the petitioner admissibility and approval of House Rent Allowance (HRA) and city Transport Allowance for the deputation period from 14.09.2009 to 03.07.2024 at place of deputation in the office of D.L.D.A. (District Level Development Authority), Patna.

For issuance of direction to the respondent authorities to grant the petitioner benefit of annual increment in terms of Bihar Seva Sanhita Rule 78 and other financial Rule, the petitioner had been retired on 31.12.2019 as post of Project Officer, Frozen Semen Bank cum Bull Station, Patna as per rule of increment in the State of Bihar employee therefore in which rule increment to pay a fixed date of an yearly.

Any other relief/reliefs to which petitioner is found entitled to in the facts and circumstances of the case."

Having heard learned counsel for the parties and having perused the contents of the petition, the writ application is disposed off directing the petitioner to file a representation before the Joint Secretary, Animal Husbandry and Fisheries Resource Department, Government of Bihar (respondent no. 3) within a period of four weeks.

4. In case such a representation is filed, the same shall be decided by the respondent no. 3 within a period of two months from the date of its filing and any amount found payable shall be paid within the said period.

5. In case the amount prayed for by the petitioner is not found payable, reasoned order for the same shall be communicated to the petitioner forthwith.

6. It is made clear that the Court has not gone into the merits of the case of the petitioner which is to be decided by the respondent concerned.

7. The writ application stands disposed off with the above observations and direction.
