During the pendency of the writ application, the respondents have accepted the claim of petitioner nos. 2 and 4, but no decision was taken with regard to petitioner nos. 1 and 3.

Patna High Court CWJC No.11931 of 2017(4) dt.01-08-2019 2/2 Since the grievance of the petitioner nos.2 and 4 has already been redressed, the writ application with regard to them has become infructuous.

Considering the fact that the respondents have taken the decision with regard to petitioner nos. 2 and 4, the Court directs the respondents to take appropriate decision with regard to petitioner nos. 1 and 3 at the earliest preferably within a maximum period of 60 days from the date of receipt/production of a copy of this order and if the respondents admit the entitlement of petitioner nos. 1 and 3, the monetary benefit must reach to time within a further period of 30 days from the date of decision by the respondents.

While taking decision, the respondents have to take into consideration Annexure-9 to the writ application dated 06.07.2017.
