JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-05-2018 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Daraunda PS case no. 50 of 2018 instituted for the offences punishable under Section 373 of Indian Penal Code and 3/4/5 of Immoral Traffic (Prevention) Act, 1956.
The allegation of the prosecution is that upon the police having searched the rooms of a hotel situated at NH 85, the petitioner was found in an objectionable condition with a lady. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and he is having a clean antecedent. It is further submitted that the statement of the lady has not been recorded by the police till date,
Patna High Court Cr.Misc. No.26904 of 2018 (4) dt.28-05-2018 2/2 hence the complicity of the petitioner is doubtful in the present case, inasmuch as, at best the present case is a case of consenting party having voluntarily gone to the hotel and stayed there. Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XI, Siwan in connection with Daraunda PS case no. 50 of 2018.
