Petitioner, already in custody, seeks bail in connection with Kankarbagh PS Case No.685 of 2016, registered under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR and stolen motorcycle has not been recovered from his possession, however, he was made accused only on the basis of the so called confessional statement and subsequently made accused in several other cases but there is no recovery of any incriminating material in any of the case and the petitioner has been in custody for more than a year in this case.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.24542 of 2018(2) dt.25-04-2018 2/2 circumstances, petitioner Vishal Kumar Sharma is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class-cum-ACJM, Patna in connection with Kankarbagh PS Case No.685 of 2016.
