JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-05-2018 The petitioner seeks bail in connection with Special Case No. 142 of 2017, arising out of Sultanganj P.S. Case No. 224 of 2017, dated 26.09.2017, instituted for the offences punishable under Sections 20 and 22 of the N.D.P.S. Act, 1985 and Sections 25(1-b) a, 26 and 35 of the Arms Act. It is submitted on behalf of the petitioner that the petitioner, who is a student having no criminal antecedent, has falsely been implicated in this case. As per the allegation made in the First Information Report and from the perusal of the seizure-list, it appears that the recovery of Charas has been made from co-accused/Alok Kumar and loaded country
Patna High Court Cr.Misc. No.25520 of 2018 (3) dt.17-05-2018 2/2 made pistol from Vivek Kumar. No recovery has been made from the instant petitioner.
It has also been submitted on behalf of the petitioner that under similarly situated circumstance, coaccused/Manish Kumar has been granted bail by this Court vide order dated 05.04.2018, passed in Cr. Misc. No. 12318 of 2018.
The petitioner is in custody since 27.09.2017. Considering the aforesaid facts, the petitioner, abovenamed, is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge-Cum-Special Judge, C.B.I.-II, Patna in connection with Special Case No. 142 of 2017, arising out of Sultanganj P.S.
