The petitioner has prayed for bail in connection with Complaint Case No. C2-546 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the FIR, 468 litres Nepali Saufi contained in 1560 bottles has been recovered from possession of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is falsely implicated in this case. Petitioner has no concern with the recovered liquor. In seizure list neither the quantity of liquor nor the vehicle or the mode of transport for

Patna High Court CR. MISC. No.65299 of 2019(2) dt.04-11-2019 2/2 carrying the liquor is specified. Petitioner has no criminal antecedent and he is in custody since 29.08.2019. Having heard learned counsel for the parties and considering the fact, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge II-cumSpecial Judge (Excise), Sitamarhi in connection with Complaint Case No. C2-546 of 2019.
