The petitioner seeks regular bail in connection with Kudhani P.S. Case No. 355 of 2017 for the offences punishable under Section 354(A) of the Indian Penal Code. The allegation in the present case is gruesome inasmuch as the petitioner is said to have tried to commit rape on a 3 years old child.
The learned counsel for the petitioner submits that the petitioner is languishing in custody since 07.03.2018. I have heard the learned counsel for the petitioner as also the learned AAP for the State and perused the case diary as well as the statement of the victim girl under section 164 Cr.P.C. from which the complicity of the petitioner is apparent regarding
Patna High Court Cr.Misc. No.26659 of 2018 (4) dt.09-07-2018 2/2 commission of heinous crime with a little child. In such view of the matter I do not find any merit in the present case, accordingly, the present petition is dismissed. (Mohit Kumar Shah, J) BTiwary/- U T
