Petitioner, already in custody, seeks bail in connection with Gogari PS Case No.345 of 2017, registered under Sections 25(1AA), 29, 31, 26, 35 of the Arms Act.

Allegation in brief is that on secret information that mini gun factory is being run in the banana orchard of the petitioner, the police raided the place and apprehended the accused persons engaged in manufacturing illegal arms and several machines making firearms and one unfinished revolver were recovered and the apprehended accused said that two pistols after manufacturing were handed over to the petitioner. Learned counsel for the petitioner submits that the banana orchard is an open place and particulars of the land is

No.13105 of 2018(3) dt.25-04-2018 2/2 not mentioned and the petitioner has clean antecedent; whereas the learned counsel for the State submits that mini gun factory was being run in the banana orchard of the petitioner and several machines and unfinished arms were recovered. Having considered that the allegation is of running a mini gun factory, the Court is not persuaded to grant bail to the petitioner at present, so the prayer of bail of the petitioner is rejected in connection with Gogari PS Case No.345 of 2017, pending in the court of learned CJM, Khagaria. The trial court is directed to expedite the trial and preferably conclude the same within nine months. If the trial is not concluded within the stipulated period, the petitioner may renew his prayer of bail.
