2. Petitioner seeks regular bail in connection with Tilauthu P.S. Case No. 218/ 2025 dated 12.08.2025 registered for the offence(s) punishable under Section 30(a) of Bihar Prohibition & Excise Act.

3. The main submissions advanced by the petitioner's counsel are that though the instant matter relates to the recovery of 130 litres of country-made liquor (Mahua liquor) but the same is alleged to have been recovered from a public place near passenger shed and the petitioner has been made accused mainly on account of his presence at that place and it is not the case of the prosecution that the alleged liquor was recovered from the

It is further submitted that petitioner has no criminal antecedent and he has never remained involved in similar type of offence in the past and he has been languishing in jail since 13.08.2025 and the investigation against him has been completed.

4. The learned APP appearing for the State has opposed the bail prayer of the petitioner.

Considering the aforesaid submissions advanced by the petitioner's counsel and mainly the petitioner's fair and clean antecedent as well as completion of investigation against him, this court is inclined to release the petitioner on bail. Accordingly, let the petitioner named-above be released on bail in connection with Tilauthu P.S. Case No. 218/ 2025 on furnishing bail bond of Rs. 20,000/-( Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
