2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 351(2), 352, 109, 118(1), 329(3) and 191(2) of the B.N.S., 2023.
3. During measurement and demarcation of land, a free-fight took place in which both the sides sustained injuries.
4. Learned counsel for the petitioners submits that there is case and counter case between the parties and the allegation levelled against the petitioners is general and omnibus.
5. Learned APP for the State has opposed the
Patna High Court CR. MISC. No.72288 of 2025(2) dt.15-10-2025 2/2 prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances of the case and the fact that there is case and counter case between the parties and allegation of assault is general and omnibus in nature, let the petitioners, above-named, in the event of their arrest / surrender before the learned trial Court within a period of eight weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipur, Darbhanga, in connection with Bahera P.S. Case No. 220 of 2025, subject to the condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S., 2023.
