Petitioner seeks bail in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
Allegation is that the petitioner pretended to be Coordinator of Oxygen India Company and persuaded the informant and others to deposit Rs. 1,23,000/- with the Company to get Rs.12,000/- per month from the Company. Some forged letters were also issued in the name of informant, which is available as Annexure to the FIR. The FIR further discloses name of other persons who were cheated by the petitioner and those persons have also supported the allegation before the police.
Patna High Court Cr.Misc. No.14480 of 2018 (3) dt.26-04-2018 Submission is that petitioner has got no criminal antecedent.
Petitioner is in custody since 18.12.2017. The investigation of the case is already complete and there is no material to substantiate the payment of such huge amount to the petitioner.
Considering the nature of allegation, let the petitioner, above named, be released on bail after framing of the charge or completion of four months of custody from today whichever is earlier on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Patahi Police Station Case No.195 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
