2. Petitioner seeks regular bail in connection with Barh P. S. Case No. 12 of 2018 in a case registered for the offence punishable under Sections 363 and 364 of the IPC and later on added Sections 302 and 120(B) of the Indian Penal Code.

3. As per prosecution case, brother of the informant went for his coaching classes on 09.01.2018 at about 8.30 A.M. and he did not come back and accordingly, search was made and the bicycle of Mithu Kumar (deceased) was found near Agwanpur Mor. It is further alleged that even the mobile number of the deceased was switched off. His brother had three friends namely, Ramesh Kumar, Ajay @ Lallu Yadav and Chintu Yadav.

4. Learned counsel for the petitioner submits that petitioner is not named in the FIR. During course of

No.71549 of 2025(2) dt.04-11-2025 2/2 investigation it has come that the deceased was in love with Kajal Kumari and the family members and uncle of Kajal had threatened the deceased of dire consequences in the event if he does not mend his way and stopped meeting Kajal Kumari, he would be killed. Petitioner is grand-father of the Kajal Kumari. He further submits that Ravindra Yadav and Jitendra Yadav who are brothers of the Kajal Kumari have already been granted bail by a co-ordinate Bench of this Court vide order dated 03.01.2022 passed in Cr. Misc. No. 37101 of 2021. Petitioner claims clean antecedent and he is in custody since 29.05.2025.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of District and Additional Sessions Judge-IV, Barh, Patna in connection with Barh P. S. Case No. 12 of 2018.
