This application for regular bail arises out of Sursand P.S. Case No. 302 of 2019, disclosing offence punishable under Section 414 of the Indian Penal Code and Sections 30(a), 38, 41 of the Bihar Prohibition and Excise Act, 2016. Petitioner is in custody since 17.08.2019. As per the case of the prosecution, a four-wheeler vehicle was found crossing Nepal Border towards the territory of Bihar by a police patrolling party. The vehicle was intercepted by the police, whereafter the occupants of the vehicle, except the petitioner, managed to flee away. From the said vehicle 531 litres of illicit liquor was recovered.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.70106 of 2019(3) dt.05-03-2020 2/2 has submitted that the petitioner has no criminal antecedent and he has been falsely implicated by the police. Considering the huge quantity of illicit liquor, alleged to have been recovered from the vehicle in which the petitioner was allegedly found, I do not consider it a fit case for grant of regular bail.

This application is accordingly rejected.
