The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Section 395 of the I.P.C.

The prosecution case, in short, is that six unknown miscreants on the point of pistol snatched the motorcycle, mobile phone and bag containing cash Rs.500/- and driving licence of the informant.

Patna High Court CR. MISC. No.65257 of 2019(5) dt.03-06-2020 2/3 It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.05.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses against the petitioner. The petitioner is not named in the F.I.R. His name has transpired in the present case on self confession made in connection with another case. Said confession led to recovery of knife. As per the report submitted by the trial court, charge has been framed and the case has been fixed for evidence. No witness has turned up for evidence. Hence the trial is not going to be concluded in near future and the petitioner has remained in custody for approximately two years.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the facts and circumstances of the case and also the lockdown, the petitioner, above named, is directed to be released on bail on his personal bond to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Mufassil P.S. case No.121 of 2018.

Once the normalcy is restored, the petitioner shall furnish bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each within a period of four
