The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

Six liters of country-made mahua wine has been recovered from a hut, situated in a paddy field. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case and he has got no concern with the alleged recovery. Nothing has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.

Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks

Patna High Court CR. MISC. No.72974 of 2022(2) dt.18-03-2023 2/2 from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court 2nd, Aurangabad in connection with N.T.P.C. Khaira P.S. Case No. 72 of 2022, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
