This application has been filed on behalf of petitioner for modification of the order dated 24.11.2022 passed by this Court in Criminal Misc. No. 57063 of 2022.
It has been submitted by the learned counsel for the petitioner that in the prayer portion of Criminal Misc. No. 57063 of 2022, inadvertently, it has been mentioned as 'to the satisfaction of learned Additional District Judge-IV-cum-Special Excise Judge-I, Lakhisarai in connection with Rail Lakhisarai Excise P.S. Case No. 167 C2 of 2022' in place of 'to the satisfaction of learned Additional District Judge-V-cum-Special Excise Judge-II, Lakhisarai in connection with Lakhisarai Excise P.S. Case No. 167 C2 of 2022' and accordingly in the order dated 24.11.2022 passed in Criminal Misc. No. 57063 of 2022, the same
Patna High Court CR. MISC. No.73221 of 2022(2) dt.22-12-2022 2/2 has been typed as 'to the satisfaction of learned Additional District Judge-IV-cum-Special Excise Judge-I, Lakhisarai in connection with Rail Lakhisarai Excise P.S. Case No. 167 C2 of 2022' in place of 'to the satisfaction of learned Additional District JudgeV-cum-Special Excise Judge-II, Lakhisarai in connection with Lakhisarai Excise P.S. Case No. 167 C2 of 2022'. In such view of the matter, let the words 'to the satisfaction of learned Additional District Judge-IV-cum-Special Excise Judge-I, Lakhisarai in connection with Rail Lakhisarai Excise P.S. Case No. 167 C2 of 2022' mentioned in the last paragraph of the order dated 24.11.2022 passed in Criminal Misc. No. 57063 of 2022 be read as ''to the satisfaction of learned Additional District Judge-V-cum-Special Excise Judge-II, Lakhisarai in connection with Lakhisarai Excise P.S. Case No. 167 C2 of 2022'
Accordingly, the order dated 24.11.2022 passed in Criminal Misc. No. 57063 of 2022 stands modified to the above extent only.
