2. The petitioner has renewed his prayer for regular bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code.

3. The present case has been registered for the murder of Pancharatna Devi who was daughter of the informant. The deceased was married with the petitioner but the accused persons including the petitioner subjected her to cruelty and committed murder.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is husband of the deceased due to which he has falsely been implicated in this case. No prior complaint was lodged

Patna High Court CR. MISC. No.72872 of 2023(3) dt.08-12-2023 2/2 against the petitioner regarding torture or harassment of the deceased. The petitioner is languishing in judicial custody since 21.3.2023.

5. It is further submitted that earlier the application of the petitioner was dismissed as withdrawn with a liberty to renew his prayer of bail after framing of charge and now, the charge has been framed which is evident from para 12 of the petition.

7. Considering the aforesaid facts as well as custody period of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with Bhabhua P.S. Case No. 167 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IX, kaimur at Bhabua.
