The petitioner seeks regular bail in connection with Jiradei P.S. Case No. 79 of 2017 for the offences punishable under Sections 302/34 of the Indian Penal Code.

The allegation is regarding the accused persons including the petitioner having assaulted the son of the informant resulting in his death.

The learned counsel for the petitioner submits that the main cause of death is assault on the son of the informant by back side of the Farsa and even if the allegation is taken on its face value, the petitioner is said to have put a Gamcha on the neck of the deceased. It is further submitted that the case diary would bear out that there is no specific allegation against the

Patna High Court Cr.Misc. No.27188 of 2018 (4) dt.09-07-2018 2/2 petitioner so as to connect him with the death of the son of the informant. The petitioner is having a clean antecedent and is languishing in custody since 25.09.2017.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Siwan in connection with Jiradei P.S. Case No. 79 of 2017.

It is further directed that the petitioner shall mark his attendance before the concerned Police station on every Monday of the week at 10 A.M. and co-operate in the investigation.
