Petitioner, already in custody, seeks bail in connection with Nawadah P.S. Case No.704 of 2017 registered under Sections 302/201 of the Indian Penal Code.

The petitioner is suspected to have killed the deceased.

Learned counsel for the petitioner submits that merely on suspicion, the petitioner has been made accused in this case and there is no eye witness to the occurrence; whereas the material against the petitioner is that he had illicit affair with the wife of the deceased and leading to his confessional statement the dead body of the deceased was recovered which was buried under the sand by the side of a river.

Patna High Court Cr.Misc. No.26511 of 2018(5) dt.19-07-2018 2/2 Having considered the aforesaid facts and circumstances, in particular recovery of the dead body at the instance of the petitioner, so prayer of bail of the petitioner is rejected.
