JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-05-2018 The petitioner seeks bail in connection with Kishanpur P.S. Case No. 261 of 2017, dated 04.02.2018, instituted for the offences punishable under Sections 379 of 411 of the Indian Penal Code.
The motorcycle of the informant which he had parked at some place was found to be missing. Hence, the case of theft of the motorcycle was lodged. The aforesaid stolen motorcycle was recovered from the house of one Santosh Yadav, which becomes evident from the seizure-list. The name of the petitioner has surfaced in the present case on the basis of confession made by aforesaid
Patna High Court Cr.Misc. No.26620 of 2018 (3) dt.18-05-2018 2/2 Santosh Yadav. The petitioner is in custody since 07.10.2017. From the impugned order, it appears that the petitioner was also found riding a stolen motorcycle. Learned counsel for the petitioner has submitted that with respect to that occurrence, another case has been lodged in which he has been granted bail. Though, the petitioner has earlier been made accused in other cases as well, but in all such cases he is on bail.
Regard being had to the period of custody of the petitioner and nature of accusation against him, he is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S. Case No. 261 of 2017.
