1. Heard Sri Krishna Prasad Singh, learned Senior Counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 498A, 506 and 509/34 of the Indian Penal Code as well as Sections 3 and 4 of the Dowry Prohibition Act.

3. Learned Senior Counsel for the petitioner submits that petitioner, being the husband, has been falsely implicated in the instant case by the informant. It is further submitted that the marriage of the informant with the petitioner was performed in the year 2005 and out of the wedlock two children were born

Patna High Court CR. MISC. No.76931 of 2024(2) dt.24-01-2025 2/3 who presently are aged about 17 years and 12 years. It is next submitted that all of a sudden, the instant case came to be instituted with exaggerated allegation. It is also submitted that petitioner is in custody since 16.07.2024.

4. Learned counsel for the informant submits that the petitioner had earlier moved this Court seeking anticipatory bail by filing Cr. Misc. No. 57747 of 2023 in which the petitioner and the informant were present in the Court Room and the petitioner agreed to take back the informant and his two daughters back to their matrimonial home and even the informant became ready but when the informant along with her daughters accompanied the petitioner to his house, there the petitioner stabbed the informant and the younger daughter on account of which a criminal case was instituted in which the petitioner was taken in custody on which learned Senior Counsel for the petitioner submits that petitioner was falsely implicated with frivolous allegation and, thus, was granted the privilege of bail in that case but while the petitioner was in judicial custody in the said case he was remanded in the present case on 16.07.2024.

5. Learned Senior Counsel for the petitioner submits that a supplementary affidavit has been filed by the petitioner

No.76931 of 2024(2) dt.24-01-2025 3/3 wherein the petitioner has stated that after his release he will ensure the well being of his two daughters on which learned counsel appearing on behalf of the informant submits that the elder daughter is doing her engineering and requires Rs.10,000/- per month towards her expenses while the younger daughter is studying in Class-VII on which learned Senior Counsel for the petitioner submits that petitioner will take the entire responsibility of his daughters' study and marriage.

6. Learned A.P.P. for the State is present.

7. Considering the submissions made by the learned Senior Counsel for the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Patna City Mahila P.S. Case No. 88 of 2022.
