The petitioner seeks regular bail in connection with Chakia P.S. Case No.31 of 2018 for the offences punishable under Section(s) 379, 420, 120B of the Indian Penal Code. The allegation is regarding the petitioner and one coaccused person having been arrested from the ATM booth and upon search two ATM cards were recovered from the petitioner and one motorcycle is also said to have been recovered. The learned counsel for the petitioner submits that a bare perusal of the FIR and the entire case diary would show that there is no allegation of any loss which have been suffered either by the informant or by any of the customer of the bank. Patna High Court Cr.Misc. No.27472 of 2018 (3) dt.30-05-2018 2/2 belongs to the uncle of the co-accused Vivek Kumar and the same has already been handed over to the uncle of the said Vivek Kumar by the police. It is further submitted that the petitioner has a clean antecedent and is languishing in custody since 18.02.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motahari, in connection with Chakia P.S.
