JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-11-2019 This is an application for grant of anticipatory bail in connection with Rajauli P.S. Case No. 195 of 2019, disclosing offences under Sections 366/34 of the Indian Penal Code. As per F.I.R. there is allegation against the petitioners and one Kundan Kumar, who happens to be the son of petitioners no.1 and 2 that they kidnapped the wife of the informant.

Submission of the learned counsel for the petitioners is that the statement of the victim lady has been recorded under Section 164 of Cr.P.C., in which, she has not named these petitioners and she stated that as she was not happy with the married life, she fled away with Kundan Kumar son of

Patna High Court CR. MISC. No.69224 of 2019(2) dt.14-11-2019 2/2 petitioners no.1 and 2. She disclosed her age about 19 years in the F.I.R.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Rajauli P.
