11-06-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application has been filed for the grant of regular bail to the petitioner in connection with Kishanganj P.S. Case No. 186/2018 for the offences punishable under Sections 454, 380 of the Indian Penal Code and later on Section 411 I.P.C. was added.

Learned counsel for the petitioner submits that there is absolutely no material to connect the petitioner with the present case. It is further submitted that even though in two other cases the petitioner has been made accused and those cases are under Section 379 I.P.C., however, he has been granted bail in those two cases. It is his further case that he is owner and driver of the vehicle which he is running

Patna High Court Cr.Misc. No.28975 of 2018 (3) dt.11-06-2018 and in course of that he has got some altercation with the police personnel, because of which he has been falsely implicated. Learned counsel submits that there is no proper seizure list in this case and the cash of Rs. 52,900/- which was recovered from the vehicle in question has never been put on test identification parade and no other stolen material has been recovered from the possession of this petitioner. Learned Additional Public Prosecutor for the State is present.

Considering the facts and circumstances of the case as also the submissions made at the bar, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Kishanganj P.S. Case No. 186/2018.
