JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-05-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have given dagger blow to the deceased as a result of which deceased died.

Earlier, the prayer for bail of the petitioner was rejected by this Court and the trial court has reported that up till now only one prosecution witness could be examined as the earlier record was pending before the Juvenile Justice Board. Learned counsel appearing the petitioner submits that petitioner is languishing in jail custody since 03.12.2016 and there is no substantive progress in the trial of the petitioner but I am not at all convinced with the aforesaid submission and taking note of the allegation leveled against the petitioner, again I am not

Patna High Court Cr.Misc. No.16089 of 2018 (3) dt.02-05-2018 2/2 inclined to release him on bail and, accordingly, his prayer for bail in connection with Session trial no. 486 of 2015 arising out of Bhagwan Bazar P.S.Case No. 196 of 2014, pending in the court of learned Chief Judicial Magistrate, Chapra stand rejected. However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible.
