This is an appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer for anticipatory bail vide order dated 05.04.2018 passed by learned 1st Additional Sessions Judge, Bhojpur at Ara, in A.B.P. No. 358 of 2018, arising out of Tarari Police Station Case No.51 of 2017 (SC/ST Case No.566 of 2017) registered under Sections 504/427/323/506/448/34 of the Indian Penal Code and Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

The FIR prima facie discloses commission of offence

Patna High Court CR. APP (SJ) No.1552 of 2018 dt.17-07-2018 P2/2 under the provisions of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. There is no material to substantiate malicious prosecution. Hence, in my view, there is no merit in this appeal against refusal of anticipatory bail.

Accordingly, the appeal stands dismissed.
