The petitioner seeks regular bail in connection with Parbatta P.S. Case No.446 of 2017 for the offences punishable under Section 392 of the Indian Penal Code.
Allegation of the prosecution is that when the informant along with co-accused villagers Ram Kumar, Amit Kumar were going to the house of sister of the informant by motorcycle, three neighbours armed with weapon intercepted informant and after assaulting them snatched their money and other articles. The petitioners is said to have been implicated subsequently in the present case.
The learned counsel for the petitioner submits that the FIR was lodged against unknown persons and in fact nothing has been
Patna High Court Cr.Misc. No.28726 of 2018 (3) dt.21-05-2018 2/2 recovered from the petitioner after his arrest in the present case. It is further submitted that the petitioner has a clean antecedent and is in custody since 19.12.2017.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Khagaria in connection with Parbatta P.S.
