JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 21.06.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Madhepura (Ghailardh) P. S. case no. 501/2016 registered under section 302 and other minor sections of the IPC. Petitioner is named in the FIR. Though no specific overt-act has been attributed against him but it is stated that he as well as others encircled the informant and the deceased and assaulted them with iron rod and lathi as a result of which deceased died in course of his treatment. Learned counsel for the petitioner submits that, as a matter of fact, one co-accused Rajendra Yadav had lodged case against the deceased prior to institution of the present

Patna High Court Cr.Misc. No.27894 of 2018 (3) dt.21-06-2018 case and that is the reason for false implication of the petitioner but I am not at all convinced with the aforesaid submissions of learned counsel for the petitioner and accordingly, prayer for anticipatory bail of the petitioner stands rejected. However, it is made clear that this order shall not cause any prejudice to the competent court at the time of consideration of regular bail application of the petitioner.
