JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Khagaria Sadar P. S. Case No. 636 of 2019, registered for the offences punishable under Sections 406, 409, 420, 34 of the Indian Penal Code.

Petitioner happens to be brother-in-law of FIR named accused Bhashkar Gupta, against whom, there is specific allegation that he took cash as well as some amount through RTGS from the informant. So far as petitioner is concerned, no specific overt-act has been attributed against him and moreover, having more or less, similar allegation, some co-accused,

Patna High Court CR. MISC. No.66931 of 2019(2) dt.27-11-2019 2/2 namely, Santosh Kumar Gupta and two others have already been granted privilege of anticipatory bail by a co-ordinate bench of this court, vide order, dated 13.11.2019, passed in Cr. Misc. No. 66610 of 2019.

Accordingly, this anticipatory bail petition is allowed and it is ordered that the petitioner, above named, in the event of his arrest/surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria Sadar P. S. Case No. 636 of 2019, subject to conditions as laid down under Section 438(2) of the CrPC.
