The petitioner apprehends his arrest in a case registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code. As per the prosecution case, all the accused persons under criminal conspiracy sold the government rice and embezzled the government money.

It is submitted that petitioner is the Representative of Ex Transport Contractor and he has not been assigned any role in the alleged occurrence. Moreover, after investigation the police has submitted final form vide Final Form No. 351 of

Patna High Court CR. MISC. No.218 of 2023(2) dt.24-03-2023 2/2 2018 dated 14.09.2018 finding the case to be false, but differing with the same learned court below took cognizance. Petitioner claims clean antecedent.

Counsel for informant vehemently opposed the prayer for bail.

Considering the facts aforesaid and the fact that final form has been submitted, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Bettiah, West Champaran in connection with Bettiah (Muffasil) P.S. Case No. 35 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
