JUSTICE ARUN KUMAR ORAL ORDER 18-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 10.2.2018, seeks bail in Kanti PS Case No. 64 of 2018 registered under Sections 400, 401, 413, 414, 379 and 511 of the IPC.

The allegation in brief is that the petitioner along with another co-accused was apprehended in the night sitting on the staircase of bank and one cuter was recovered from the possession of co-accused Amarjeet Kumar.

Learned Counsel for the petitioner submits that Amarjeet Kumar, from whose possession cutter was recovered, has been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No. 31623 of 2018 and the motorcycle recovered from the possession of the petitioner is his personal motorcycle registered in the name of his wife.

Having considered the said facts and circumstances, the petitioner, namely, Mahesh Mallik @ Mahesh Mali is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM West Muzaffarpur in connection with Kanti PS Case No. 64 of 2018.
