Petitioner is in custody since 16.11.2016 in connection with Sessions Trial No. 387 of 2017 arising out of Bihta P.S. Case No. 665 of 2016 registered under Sections 365, 341, 323, 324, 307 and 34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that earlier the prayer for bail of this petitioner had been rejected vide order dated 18.05.2017 in Cr. Misc. No. 17402 of 2017 with observation that trial may be concluded within six months from the date of the order but the trial has not yet been concluded and also not likely to be concluded in near future, which is evident from the report, at flag-'X'. The petitioner is rotting in judicial custody for the last two and half years. Considering the facts and circumstances of the case, let

Patna High Court Cr.Misc. No.25081 of 2018 (3) dt.16-05-2018 the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II, Danapur, Patna in connection with Session Trial No. 387 of 2017 arising out of Bihta P.S. Case No. 665 of 2016.
