Government Pleader (17) ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 29-10-2024 Heard Mr. Gyan Shankar, learned counsel appearing on behalf of the petitioner and the learned GP 17 for the State.

The petitioner in paragraph no. 1 of the present writ petition has sought inter alia following relief(s), which is reproduced hereinafter:- "(i) Issuance of a writ/writ(s), order/order(s) commanding the respondent authorities to pay the arrears of subsistence allowance to the petitioner for the period February, 2023 to April, 2023 and from December, 2023 till date which has illegally been withheld by the respondent authorities without any reason. It further prayed that the respondent authorities be further directed to pay the subsistence allowance regularly to the petitioner on month-tomonth basis. (ii) Issuance of any other writ(s), order(s) or direction(s) as may be deemed fit and proper by this Hon'ble Court."

3. Learned counsel appearing on behalf of the

Patna High Court CWJC No.16686 of 2024(2) dt.29-10-2024 2/2 petitioner informs this Court that the petitioner is continuously making his presence at the Headquarter [Block Office, Tekari (Gaya)] and in spite of the said fact, his subsistence allowance has been discontinued.

Learned counsel, in this regard, seeks to file a detailed representation in respect of the claim of the petitioner before the District Magistrate, Gaya and the District Magistrate, Gaya must first inquire from the Block Office as to whether the petitioner is being harassed and without any reason, his subsistence allowance, which was being paid till December, 2023 has been discontinued and also examine as to whether the petitioner was given any information in this regard. If the same has not been given to the petitioner, the same will be assumed to be in violation of principle of natural justice.

5. In case, the grievance of the petitioner is not redressed, the petitioner is at liberty to approach this Court for taking legal action against the concerned respondent(s).

6. With the above observation/direction, the present writ petition stands disposed of.
