The petitioner seeks bail in connection with Motihari Town Police Station Case No. 464 of 2016 registered for an offence punishable under section 386 of the Indian Penal Code. The informant has alleged that a call was made from Mobile no. 9779803779342 and ransom of Rs.20,00,000/- (twenty lacs) was demanded.
It has been submitted that the name of this petitioner has been divulged by one Munchun Sah who was apprehended by Police. The said Munchun Sah has been allowed regular bail by one of the coordinate Bench of this Court in Cr. Misc. No. 8119 of 2017. The aforesaid SIM has been found in the name of one Sonu
Patna High Court Cr.Misc. No.24145 of 2018 (3) dt.18-05-2018 2/2 Singh @ Sonu Pratap Singh @ Abinash Singh who has also been allowed regular bail in Cr. Misc. No. 2068 of 2018. The petitioner is in custody since 02.05.2017 having clean antecedent and so he deserves bail.
The learned Additional Public Prosecutor on the other hand opposed the submission.
Considering the case of this petitioner on similar footing to the case of co-accuseds who are on bail, the prayer for bail of the petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Motihari in connection with Motihari Town Police Station Case No. 464 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
