The petitioner seeks bail in connection with Special Case No. 47 of 2018 arising out of Beur P.S. Case No. 146 of 2018 for the offence under Sections 324, 307, 353, 120B, 224 and 511 of the Indian Penal Code and Sections 25(1-b)a, 26, 27 and 35 of the Arms Act and Section 3/5 of the Explosive Substance Act, 1908.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the co-accused having more or less similar allegation has already been granted regular bail by a co-ordinate Bench of this Court in Cr. Misc. No.

Patna High Court CR. MISC. No.65038 of 2019(2) dt.25-10-2019 2/2 31637 of 2019, Cr. Misc. No. 29042 of 2019, Cr. Misc. No. 508 of 2019 and Cr. Misc. No. 55951 of 2018 which is evident from Annexures- 1,2,3 and 4, and the case of this petitioner stands of similar footing. The petitioner is rotting in judicial custody since 03.08.2018. Hence, the petitioner may be enlarged on regular bail.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-1st, Vigilance, Patna in connection with Special Case No. 47 of 2018 arising out of Beur P.S. Case No. 146 of 2018.
