The petitioner apprehends his arrest in connection with Tarari P.S. Case No. 83 of 2019, registered under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act. The accusation is that in the midnight of 15/16-5-2019, Vikash Paswan, Bhagina of the informant, Rakesh Paswan, along with Munna Singh (petitioner) entered in the house of informant and fired at him, because Munna Singh (petitioner) has illicit relation with his sister, Binda Devi, regarding which, informant made protest. Learned counsel for the petitioner submits that, in fact, due to property dispute in between the informant, Rakesh Paswan and his sister, mother of co-accused, Vikash Paswan, the present case has been lodged with false allegation and this petitioner being the

Patna High Court CR. MISC. No.64516 of 2019(3) dt.04-12-2019 2/2 friend of Vikash Paswan, who is son of sister of the informant, has also been implicated in the present case.

Mr. A.M.P. Mehta, learned A.P.P. appearing for the state while opposed the prayer for pre-arrest bail of the petitioner submits that in the case diary, which is up to paragraph 36, injury with regard to the informant has not been detailed.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Tarari P.S. Case No. 83 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
