The petitioner seeks regular bail in connection with Katra P.S. Case No. 102 of 2017, registered for the offence punishable under Sections 376(D), 120(B), 354 of the Indian Penal Code and Sections 4 /6 of the POSCO Act.

The allegation is regarding the accused persons including the petitioner having caught the victim girl and committed rape on her.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and he is languishing in custody since 03.10.2017. It is further submitted that the petitioner is having a clean antecedent. I have heard the learned counsel for the parties and gone

Patna High Court Cr.Misc. No.24763 of 2018(3) dt.03-07-2018 2/2 through the case diary, which was called for by this Court and I find that the petitioner is fully involved in the aforesaid heinous act of rape with the victim girl and even the medical report suggests that rape was committed with a minor girl. In view of ample materials being available in the case diary to connect the petitioner with the alleged crime and the crime being a heinous one, I am not inclined to grant bail to the petitioner herein. The prayer for bail made by the petitioner is rejected.
