The petitioner seeks regular bail in connection with Rajoun P.S. Case No. 38 of 2018 for the offences punishable under Sections 342, 323, 377 and 34 of the Indian Penal Code. The allegation is regarding the petitioner having sodomised the victim boy and both of them are said to be of the same age and reside in the same lodge.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. He is having a clean antecedent and is languishing in custody since29.01.2018.

Having regard to the facts and circumstances of the

Patna High Court Cr.Misc. No.24794 of 2018 (3) dt.04-07-2018 2/2 case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No. 38 of 2018.
