2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Kumarkhand P.S. Case No. 188 of 2022 registered for the offence punishable under Section 392 of the Indian Penal Code.

3. Earlier the bail application of the petitioner has been rejected vide order dated 05.07.2023 passed in Cr. Misc. No. 38391 of 2023.

4. The following order was passed on 05.07.2023 in Cr. Misc. No. 38391 of 2023 which reads as under:

This application for grant of regular bail arise out of Kumarkhand P.S. Case No. 188 of 2022 registered for the offence punishable under Section 392 of the Indian Penal Code.

It is alleged that petitioner looted cash from the counter of the shop along with coaccused and he was apprehended on the spot. Petitioner has similar antecedents.

In view of the aforesaid fact, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer of bail of the petitioner is rejected herewith. The concerned District Court is directed to make trial of all the cases at the earliest in one Court.

(i) Kumarkhand Police Station Case No. 182 of 2021 under Section 341, 323, 307, 379, 504/34 of Indian Penal Code.

(ii) Kumarkhand Police Station Case No. 331 of 2021 under Section 392, 34 of Indian Penal Code.

(iii) Jankinagar Police Station Case No. 27 of 2020 under Section 25 (1-B) a 26 Arms Act.

(iv) Jankinagar Police Station Case No. 171 of 2021 under Section 414 of the Indian Penal Code and 27 Arms Act.

(v) Belari O.P. Police Station Case No.

332 of 2021 under Sections 423, 307, 34 of the Indian Penal Code and 27 Arms Act.

(vi)Murliganj Police station Case No.

380 of 2019 under section 392 of Indian Penal Code."

5. The charges have been framed in the case and witnesses are yet to be examined.

6. Considering the fact that the petitioner was caught on the spot, no ground for review of my earlier order is made out.

7. Accordingly, the application stands dismissed.

8. The Superintendent of Police, Madhepura is directed to ensure the attendance of the witnesses in the case.
