JUSTICE BIRENDRA KUMAR ORAL ORDER 30-07-2018 The explanation of the Judicial Officer concerned would reveal that Office Assistant of the Court was responsible for improper compliance of the order of this Court. The District Judge, Katihar is expected to take appropriate action in this matter.
With the aforesaid observation, the explanation of the Judicial Officer is accepted.
Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offences punishable under Sections 147/148/341/323/379/307/ 354/504/506 of the Indian Penal Code. Later on offence under Section 302 of the Indian Penal Code was added.
Patna High Court Cr.Misc. No.30173 of 2018 (7) dt.30-07-2018 P2/ The petitioner is in custody since 20.02.2018. Allegation is that he had assaulted with iron rod on Kamna Devi causing injury at her head. However, there is no allegation of commission of assault against the deceased by this petitioner. Submission is that some other co-accused has already been allowed bail vide Annexure-2.
Considering the nature of allegation against the petitioner and the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Manihari P.S. Case No.194 of 2016, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
