Mr.Shaheen Begum ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 25-11-2019 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

Petitioners seek regular bail in connection with G.O. Case No.162 of 2019, for the offence punishable under Sections 30(a) and 56(d) of the Bihar Prohibition and Excise Act. The prosecution story is that the vehicle of the petitioner in which they were sitting was intercepted by the police and total quantity of 168 litres of illicit liquor was recovered from the said vehicle.

Mr. Ajay Thakur, learned counsel appearing for the petitioners submits that petitioners have got no criminal

No.62914 of 2019(3) dt.25-11-2019 2/2 antecedent and have falsely been implicated in this case inasmuch as they were found sitting in the vehicle and from the dicky of the said vehicle, 168 litres of illicit liquor were recovered. Learned counsel further submits that there is no allegation that the petitioners are owner of the vehicle. Learned counsel also submits that petitioners are in custody since 11.08.2019.

Having regard to the submissions made by the parties and taking into consideration the fact that petitioners have got no criminal antecedent and they are in custody since 11.08.2019, I am inclined to grant regular bail to both the petitioners. Accordingly, let both the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District& Sessions Judge-IIcum-Special Judge (Excise Act), Nawada, in connection with G.O. Case No.162 of 2019.
