The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code The prosecution story, in brief, is that the informant alleged that daughter of the informant was got married with coaccused Saiyad, subsequently put top harassment and torture by blaming her for having illicit relationship with this petitioner. It is further alleged that the on 10.12.2021, informant's daughter is found dead by hanging thereafter, the informant raised suspicion that the petitioner is involved in this alleged offence. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The

Saiyad and there was no good relation between them due to this reason the petitioner has falsely been implicated in this case merely on suspicion. The petitioner has no concern with the deceased as well as her husband and living separately from them. The petitioner has got no criminal antecedent and languishing in judicial custody since 14.10.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bounsi P.S. Case No. 130 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st Araria.
