JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2020 The petitioner seeks regular bail in connection with Kotwali P.S. Case No. 89 of 2019, registered for offences punishable under Sections 307, 387/34 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution case is that petitioner and other accused persons intercepted the informant and demanded extortion of Rs. One Lakh and assaulted him and there is also allegation of firing against other accused persons. It further appears that petitioner is accused in six other cases.

It has been submitted on behalf of the petitioner there there is no allegation against the petitioner of assault to the informant and save and except the petitioner is named in the F.I.R., there is nothing against him and in all the cases, he has been remanded after arrest in the present case and he has been in

Patna High Court CR. MISC. No.72475 of 2019(3) dt.10-01-2020 2/2 custody for nine months.

Having heard both sides, considering the submission as above, this application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Kotwali P.S. Case No. 89 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds with further subject to condition that petitioner has to appear before the Officer-in-Charge of the police station of his area in the first week of each month for a period of nine months or till disposal of trial, whichever is earlier, so that the police may watch his conduct during that period.

Let a copy of this order be communicated to the Senior Superintendent of Police, Gaya for needful.
