====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 30-07-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 447, 342, 302 of the Indian Penal Code and Section 27 of the Arms Act. Several persons are named in the FIR. Allegation against the petitioner is that on the order of this petitioner coaccused Sanjeev Mandal caused firearm injury to Shekhar Bhai Patel which resulted in his death. Allegation of firing is against other persons also.

Submission is that the order of the learned court below would reveal that the deceased as well as Sanjeev Mandal have got criminal antecedent. The petitioner has got no criminal antecedent nor he has got any concern with those persons.

Learned counsel for the informant opposed the prayer for bail vehemently.

Considering the nature of allegation and period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.T. Case No. 130 of 2018 arising out of Kahalgaon (Rasalpur) Police Station Case No. 557 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
