JUSTICE ARUN KUMAR ORAL ORDER 04-05-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Khodawandpur P.S.Case No. 114 of 2017 registered under Sections 120B, 201 and 302/34 of the Indian penal Code.

Allegation in brief is that informant's son was found murdered and thrown in a field and the informant raised suspicion against the petitioner as love affairs was going on with the petitioner's sister to the deceased so on that account they might have killed his son.

Submission is that a SIM card was recovered from the place of occurrence belonging to accused persons and during investigation one person Awadhesh Kumar was apprehended by the police who made disclosure in his confessional statement that one Pankaj Pandit had killed deceased and thrown the dead

Patna High Court Cr.Misc. No.14584 of 2018(3) dt.04-05-2018 2/2 body in the field and motive of commission of alleged crime, as per confessional statement, was also entirely different though the petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Rakesh Kumar Mahto is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned SDJM, Manjhaul (Begusarai) in connection with Khodawandpur P.S. Case No. 114 of 2017.
