ANJANA MISHRA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Kishanganj P.S. Case No.345 of 2019 registered for the offence punishable under Sections 341, 323, 307, 379/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that there is general and omnibus allegation against all the petitioners excepting petitioner no.3 Abdul, who is said to have attacked the daughter of the informant with wooden rod. It is further submitted that there is a land dispute between the parties and the
Patna High Court CR. MISC. No.68405 of 2019(2) dt.27-11-2019 2/2 entire family has been roped in.
Considering the aforementioned facts and circumstances, let petitioner Nos.1, 2, 4, 5 and 6, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj, in connection with Kishanganj P.S. Case No.345 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
So far as Petitioner No.3, namely, Abdul is concerned, since there is specific allegation against him and the injuries purported to have been inflicted by him have been found to be grievous in nature, I am not inclined to grant anticipatory bail to him. The prayer for anticipatory bail of Petitioner No.3 Abdul stands rejected.
